Terms & Conditions
Last updated
These terms apply to your use of this website and to any reservation made with, or meal taken at, Anaya, 20-22 Victoria Terrace, Leamington Spa CV31 3AB, operated by Anaya Restaurants Limited (company no. 17269971). Our premises are held by Anaya Buildings Limited (company no. 17270047). By using the site or dining with us you accept them.
1. Website use
Content on this site — including menus, images, the Anaya name and logo — is our property or used under licence and may not be copied or reproduced without permission. Menus, dishes and prices are illustrative and may change without notice; nothing on this site is a binding offer.
2. Reservations
A reservation is confirmed only when we confirm it in writing. Tables are held for 15 minutes after the booked time. We may require a card guarantee or deposit for larger parties and peak dates; where we do, the amount and terms are given at the time of booking.
3. Cancellations and no-shows
Please give at least 24 hours' notice to cancel or reduce a party. For bookings taken with a deposit or card guarantee, a cancellation charge of up to £30 per guest may apply for late cancellations or no-shows, reflecting our genuine loss. Deposits for private events are governed by the event contract issued at the time of booking.
4. Prices, service and payment
All prices include VAT at the prevailing rate. A discretionary service charge of 12.5% may be added to the bill; it is discretionary and can be removed on request, and tips and service charge are distributed to our team in accordance with the Employment (Allocation of Tips) Act 2023. Payment is due at the end of the meal.
5. Allergies, intolerances and food safety
Our kitchen handles all 14 statutory allergens, including cereals containing gluten, milk, eggs, fish, crustaceans, molluscs, peanuts, tree nuts, sesame, soya, celery, mustard, lupin and sulphur dioxide. Because dishes are prepared in a single kitchen we cannot guarantee any dish is free from traces of an allergen, and we cannot accept liability where a guest has not told us of an allergy or intolerance before ordering.
You must inform a member of the team of any allergy or dietary requirement before you order. Full ingredient information is available on request. Some dishes contain raw or lightly cooked ingredients; consuming these may increase the risk of foodborne illness, particularly for vulnerable guests. If you believe you have suffered a reaction or illness following a meal with us, tell us as soon as possible so we can investigate and notify the relevant authority where required.
6. Conduct, children and personal property
We may refuse service or ask a guest to leave for abusive, threatening or unsafe behaviour. Children must be supervised by an adult at all times. Personal property is brought onto the premises at your own risk; items left in cloakrooms are accepted on the basis that we are not liable for loss or damage except where caused by our negligence.
7. Alcohol and licensing
We operate a Challenge 25 policy: if you look under 25 you will be asked for photographic ID (passport, UK photocard driving licence or PASS-accredited card). It is an offence to buy alcohol for anyone under 18, and we may refuse service to anyone who appears intoxicated. Alcohol is served in accordance with our premises licence.
8. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the terms implied by the Consumer Rights Act 2015, or for any other liability that cannot lawfully be limited.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, or loss arising from events outside our reasonable control (including power failure, supplier failure, extreme weather, strike action or public-health restrictions), and our total liability in connection with any single visit is limited to the value of the sums paid by you for that visit — except in respect of personal injury or illness, where the exclusions in this paragraph do not apply.
If you are a consumer, your statutory rights are unaffected: food and drink must be of satisfactory quality, fit for purpose and as described, and service must be carried out with reasonable care and skill.
9. Sourcing and supply chain
Where reasonably possible and responsible to do so, we seek to back British farmers and suppliers, and to use ethically sourced ingredients that are fairly traded and form part of the British Red Tractor assured supply chain. Red Tractor and Back British Farmers endorsement is an aspiration and ongoing commitment, not a guarantee that every ingredient is UK-sourced or Red Tractor certified: some specialist produce and spices are sourced from trusted international suppliers and we rely on supplier representations as to their certification and welfare standards. We are not liable for the acts or omissions of third-party suppliers, save where caused by our negligence.
10. Company details
